Navigating Space and Aviation Disputes

The diversity of stakeholders in the aviation sector, its international nature, and the risks associated with such diversity lead to a wide variety of disputes. At the same time, the overlapping and sometimes conflicting nature of legislation makes it difficult to resolve disputes in a uniform manner, while air transport users expect uniform solutions. This is why the choice of an alternative method (arbitration/mediation) and the applicable law require careful consideration and, at times, considerable imagination on the part of the lawyers responsible for drafting clauses or managing disputes.

Based on experiences in different jurisdictions, the panel will share pertinent case law, provide best practice tips, and consider whether there is a way to harmonize the rules applicable in the aviation industry, which is global in nature.
