Cybersecurity, Data Integrity, and Real-Time Dispute Resolution in International Construction Projects

This joint session, organized by the International Construction Projects Committee (ICP) and the Dispute Resolution and Arbitration Committee (DRAC), will bring together construction dispute practitioners, experts, and corporate counsel to explore modern approaches to real-time dispute avoidance, adjudication, and resolution in international construction and engineering contracts. Building on the evolving intersection between cybersecurity, data integrity, and dispute management, the panel will examine how secure digital practices and data governance can enhance transparency and efficiency in real-time dispute mechanisms.
Speakers will compare the relevant provisions in major international standard forms of contract, notably FIDIC and NEC, and discuss related initiatives such as those of UNCITRAL and the International Statutory Adjudication Forum. The discussion will also consider how digital dispute management tools and expedited arbitration procedures promoted by leading institutions can support faster and more effective outcomes. Delegates will hear from leading international practitioners offering hands-on insights and practical guidance on how these procedural and technological innovations can be adapted for use in any construction contract.

Karen Gough is a Barrister in practice at 39 Essex Chambers, London, an Attorney-at-law (Jamaica and Trinidad and Tobago), Chartered Arbitrator and accredited Adjudicator.

Karen practises internationally as counsel, attorney-at-law, arbitrator, adjudicator and ADR neutral. She has specialised, for more than 30 years, in complex construction, engineering, professional negligence and general commercial disputes whether resolved by litigation, arbitration, adjudication  or other forms of ADR. She has appeared before the Courts of England and Wales at all levels including the Privy Council. Karen is dual qualified as a practising attorney in the Caribbean, a Chartered Arbitrator, a Certified International ADR Practitioner and is widely recognised as an expert in the resolution of disputes under the FIDIC and NEC forms of contract.

She is a past global President of the Chartered Institute of Arbitrators, an expert advisor on construction, ADR and arbitration matters to the AIAC (Malaysia), IWHAAM (Bahamas), and JAIAC (Jamaica), a teaching fellow at the College of Law in Australia, past Vice Chairman of SCL UK, a member of the International Statutory Adjudication Forum of Experts (“ISAF”) and Chair of the drafting committee of ISAF’s Model Law on Adjudication, and Co-Chair of the ICPC of the IPBA.

Zach Song

Zach Song is experienced in conducting international arbitrations and advising on disputes in the energy sector.

Zach is a partner at Steptoe in its international disputes group working in New York City, and had previously worked in London, Singapore, Bangkok and  Seoul.  Zach is a specialist in dispute resolution and has worked on international arbitrations and litigation in relation to nuclear technology, oil and gas projects, solar power plants, high voltage cable interconnector projects, and energy storage system projects in the United States.  Zach sits as a registered panel arbitrator of several Asian arbitral institutes, serves as mediator of the International Division of the Korea Commercial Arbitration Board (KCAB), and also serves as a panel lawyer for the Ministry of Justice of South Korea regarding Singapore related matters.  Zach is a pragmatic problem solver and having worked on international arbitration around all major arbitral institutes, he also believes strongly in mediation and has represented clients in complex mediations including those administered by the Singapore Mediation Centre.  Zach travels back to Asia often to work with clients on their international disputes matters.
